දේවාපහසය - නීති ප්‍රතිසංස්කරණය සඳහා පෙල ගැසෙන්න

පකිස්තාන් සිද්ධියෙ වින්දිතය එහෙම මරාදමන්න කරපු වරද ගැන පිටස්තර හැමෝම තාම දන්නෙ ආගමට අපහාස කරා කියන චෝදනාව හෝ කාර්මික ආරවුලක් පිළිබඳ ප්‍රශ්ණයක් කියන එකයි.

ඔය දෙකෙන් කෝක උනත් දැන් වැඩිපුර කතාවෙන්නෙ දේවාපාහසය පිළිබඳ කතාව.

ලංකාවෙත් දේවාපහසය පිළිබඳ නීති (Blasphemy laws) තාමත් නීති පොතේ තියෙනව.

අපි [කර්තෘ සංසදය, නිදහස් මාධ්‍ය ව්‍යාපාරය, පුවත්පත් ප්‍රකාශයින්ගේ සංගමය, (අවුරුදු 20කට පස්සෙ රටේ සියලුම මාධ්‍ය සංවිධානත් එකතු උනා ඒ ඉල්ලීමට)]

1998 ඉඳන් ඉල්ලනව එම නීති, නීති පොතෙන් ඉවත්කරන්න, ඒක අදහස් ප්‍රකාශ කිරීමේ නිදහසට බාධාවක් කියල. මාධ්‍ය නිදහස හා සමාජ වගකීම පිළිබඳ කොළඹ ප්‍රකාශණයෙ ඒ ඉල්ලීම තියෙනව. ඒකට අවුරුදු 20ක් උනාම නිදහස් මාධ්‍ය ව්‍යාපාරය වෙනුවෙන් අත්සන් කරේ මම. මම දැන් ලංකාවෙ සීන් එකේ වැඩිය නැති නිසා මොකද වෙලා තියෙන්න කියල දන්නෙ නැහැ.


නමුත් මේ නීති, එක්සත් ජාතීන්ගේ මානව හිමිකම් ප්‍රඥප්තියට අනුකූලව ප්‍රතිසංස්කරණය කර ගැනීම සඳහා පෙල ගැසෙන්න ඕනෙ. ලංකාවෙ නම් මේව යොදා ගන්නෙ බුද්ධාගමට අපහාස වෙන දේවල් කිව්ව, අච්චු ගැහැව්ව කියල දඬුවම් කරන්න. ඒව මේ කොටස්:



Articles 290-292 of the Penal Code provide the framework for restricting expressions that hurt religious sentiments. Article 291A and 291B limit expressions that are deemed offensive to religion.


Article 291A states:

“Whoever, with the deliberate intention of wounding the religious feelings of any person, utters any word or makes any sound in the hearing of that person, or makes any gesture in the sight of that person, or places any object in the sight of that person, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.”


Article 291B states:

“Whoever, with the deliberate and malicious intention of outraging the religious feelings of any class of persons, by words, either spoken or written, or by visible representations, insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”
